Legal Guarantee of Conformity — EU Consumers
Last updated: 08/10/2026
1. What This Policy Covers
If you are a consumer residing in the European Union and you purchase goods from us, you are entitled to a legal guarantee of conformity under Directive (EU) 2019/771. This legal guarantee applies in addition to any commercial warranty we may offer and is separate from your 14-day right of withdrawal.
2. Duration of the Legal Guarantee
We are liable for any lack of conformity that becomes apparent within 2 years from the date of delivery of the goods.
Note: Some EU Member States may provide a longer guarantee period under their national law. Where this is the case, the longer period will apply.
A “lack of conformity” means the goods:
Do not match the description, type, quantity, or quality agreed in the contract;
Are not fit for the purposes for which goods of the same type are normally used;
Do not possess the qualities and features (including durability, functionality, compatibility, and security) that you may reasonably expect;
Were not delivered with all accessories and instructions, including installation instructions;
Do not receive necessary updates (including security updates) where the goods contain digital elements and the contract provides for such updates.
3. Burden of Proof
If a defect becomes apparent within 1 year of delivery, it is presumed to have existed at the time of delivery. This means you do not need to prove that the defect was present when you received the goods. The burden is on us to prove otherwise, unless this presumption is incompatible with the nature of the goods or the defect.
Note: Some EU Member States extend this presumption period to 2 years. Where applicable, the longer period applies.
4. Your Remedies
If the goods are defective (lack conformity), you are entitled to the following remedies:
First tier — Repair or Replacement (your choice):
You may choose between repair or replacement of the goods. This must be done:
Free of charge
Within a reasonable time after you notify us
Without significant inconvenience to you
We may refuse your chosen remedy only if it is impossible or would impose disproportionate costs on us, taking into account the value of the goods and the significance of the defect.
Second tier — Price reduction or termination:
If repair or replacement is impossible, disproportionate, or has not been completed within a reasonable time, you are entitled to:
A proportionate reduction in price, or
Termination of the contract (full refund) — unless the defect is only minor.
5. Right to Repair — Extended Guarantee (from 31 July 2026)
Under Directive (EU) 2024/1799, where you choose repair instead of replacement for a defective product, the legal guarantee period is extended by 12 months from the completion of the repair. This extension applies once.
When you report a defect, we will inform you of your right to choose between repair and replacement, and the implications of choosing repair (including the 12-month extension), before carrying out any remedy.
6. How to Make a Claim
To exercise your legal guarantee rights, please contact us at:
info@studiolinzie.com
Please provide:
· Your name and order number
· A description of the defect
· Photos or videos where possible
We will respond within 2 business days and arrange the appropriate remedy.
7. Relationship with Commercial Warranty
Any commercial warranty we offer is in addition to and does not affect your legal guarantee rights. If our commercial warranty offers terms more favourable to you than the legal guarantee, the more favourable terms will apply.
8. Relationship with 14-Day Right of Withdrawal
The 2-year legal guarantee is separate from your 14-day right of withdrawal. You may exercise the right of withdrawal for any reason within 14 days of delivery. After 14 days, your rights are governed by this legal guarantee policy.
